Booking Terms Dalvey House, * see note at the end of booking form.

Liability of Responsible Applicant

The Client certifies that he or she is authorised to sign the booking form on behalf of the persons who will occupy the property during the period for which it has been blocked and that they are all, apart from infants, aware of the booking conditions. The maximum number of guests who may occupy the House and its surrounding grounds are indicated on the booking form when booking. Exceeding this number constitutes a breach of contract and the owner of the property has the right to terminate the booking forthwith and all moneys paid by the client will be forfeit.

Conformation of booking

No booking will be accepted by Dalvey House unless an appropriate signed booking form and down payment for the *holiday has been received by Dalvey House. Surcharges will apply to overseas bank transfers. Having signed the booking form, the client accepts liability for the full payment of the * holiday rental. In the event the *holiday is cancelled by the client; the Client remains liable for full payment of the *Holiday rental.

A 25% deposit must accompany the booking request.

Cancellation by the Applicant

Any cancellation made by the client for whatever reason shall be in writing and addressed to Dalvey house at its designated address. Deposits and balances are non-refundable in the event of cancellation not covered by appropriate insurance. The client remains liable for the final payment on the due date (8 weeks prior to the date of the booking) failure to do so is a breach of contract. Dalvey House reserves the right to re-let where any monies due are more than fourteen days in arrears and the guest will be responsible for the outstanding fee if Dalvey House cannot be re-let within the same time frame.

We strongly recommend that you take out appropriate insurance in case of cancellation.

Accuracy

Whilst representations both verbal and visual contained in any marketing literature including the website are made in good faith. The owner and his/her employees use their best endeavours to ensure the accuracy of all information however from time to time there may be a minor difference between the actual property and its description, as the owner constantly strives to improve services and facilities, or because a problem or modification renders service or facility unavailable. Any changes to the facilities or fixtures available are considered to be minor changes and no compensation is available. In the event that such a change is likely to affect the client’s enjoyment the Owner will contact the client as soon as is deemed reasonably possible.

Balance payment

Final payments set out in the booking form are due eight weeks before a *holiday

Commences.

VAT

All prices quoted include VAT.

Duration of rental

Entry on day of arrival is from 4pm (on *holiday start date) and exit time is 10am (on *holiday departure date) unless otherwise specified. These times must be strictly adhered to unless by special arrangement with the owner or key holder.

Accommodation unavailable

In the event of the accommodation becoming unavailable (such as fire or flooding), Dalvey House will refund all monies paid or a proportion in the case of curtailment. We cannot however pay any compensation or expenses as a consequence of such an event.

The Holidaymaker shall keep the property and all furniture, fixtures and fittings and effects in or on the property in the same state of repair as at the commencement of the holiday and shall leave the property in the same state of cleanliness and general order in which it was found. The Holidaymaker must report and pay to the Owner the cost of any damage or breakages made during their holiday occupancy.

Good Housekeeping Deposit (GHD)

There is a good housekeeping deposit of £500 payable seven days before the *holiday commences and will be returned seven days after the end date of the *holiday if no damages are incurred. The client is responsible for reimbursing the Owner for actual costs of any breakage or damage in or to the property (beyond the reserve), along with an additional cost that may result.

No Smoking

Dalvey House has a non-smoking policy.

The Owner or his representative shall be allowed access to the Property at any reasonable time during any holiday occupation.

Cancellation by the Owner

The Owner is entitled at His/her sole and absolute discretion to refuse to hand over to the Client, or to repossess the property (which includes the fixtures, fittings, furnishings and decorations) if the owner reasonably believes that any damage is likely to be caused, has been caused or is being caused by the Client or any member of the group. These circumstances will be treated as a cancellation by the Client. No refund of any monies paid in respect of the booking will be made and the owner is under no obligation to find alternative accommodation for the group.

If the Owner is prevented, because of circumstances beyond his reasonable control, e.g. (fire, damage, drought, interruption of utilities, Act of God) from putting his property at the disposal of the Client, the hire charge shall be refunded in full, and the Client shall have no further claim against the owner.

If the Client or member of the group are unable to access the property for factors outside the Owner’s reasonable responsibility, the Owner will not accept any liability for compensation or refunds for part or full loss of the *Holiday.

Users Risk

The use of amenities provided by the Owner is entirely at user's risk and no responsibility can be accepted for any injuries to persons or loss or damage to any belongings of persons who use them.

Personal information you supply will never be supplied to anyone else without your consent, unless we are obliged by law.

Tenancy Agreement

The contract effected on receipt of confirmation of the booking is in terms of the Housing Scotland Act 1988 and confers on the Client the right to occupy the property for the period agreed for the holiday purpose only. The clients statutory rights are not affected by anything contained within these terms & conditions.

We may disclose your personal information to the owners and employees of Dalvey House insofar as reasonably necessary for the purpose set out in this policy.

We will never share any of your details, such as names or emails with other companies or third parties unless instructed to do so.

The majority of information we have on guests is names, addresses, email and phone numbers. All personal information collected through the booking form in this website will be used only for the purpose intended, eg to answer an enquiry, process a holiday booking, legal, accounting, or reporting requirements. Personal information will not be retained for longer than is necessary in order to satisfy the booking made or the requirements necessary for the information to be held. Any bank details required for booking purposes will be deleted.

Dalvey House does not retain any information on your WiFi usage while staying at the house.
